Short Term Vacation Rental Policy Checklist

The short-term vacation rental market has exploded in Minnesota in the last ten years, with experts indicating that there are now as many as 8,000 units in the state.  As local governments look to modernize their ordinances to strike the right regulatory balance, we provide the following best practices checklist for policy consideration.  We encourage local governments to consider including the following requirements for short-term vacation rentals in order to create a fair and level playing field:
 
□  Registration or licensure with the local government and appropriate fee structure
□  Requirement that license number be posted on any online listing/advertisement
□  Licensure from the Minnesota Department of Health or county delegate
□  Certification that operator will pay all appropriate taxes, including any lodging tax
□  Purchase and maintenance of the appropriate insurance coverage
□  Compliance with the appropriate fire code for overnight accommodations
□  Environmental and water quality standards (including septic system compliance)
□  Appropriate consideration for zoning within the jurisdiction
□  Compliance with noise/quite hours, sanitation, parking and trespass rules
□  Maintain a 24 hour/day contact person(s) to resolve complaints swiftly and consider setting a specific response time as decided by the local government
□  Contemplate use of third-party technology to locate and/or communicate with short-term vacation rental units within the jurisdiction
